International Literature on Smart Contracts and Its Development: An Analysis
Abstract:
This paper contains a brief review of international sources on smart contracts and theirchangingnature in the legal system. Smart contracts, i.e. selfexecuting digital contracts facilitated byblockchain technology create big challenges and great opportunities to contemporary contractlaw. Based on their comparative jurisdiction studies in the USA, EU, and India, the paperpresents some of the most pertinent legal issues such as enforceability of these jurisdictions anddata protection, who is a legal jurisdiction, and whether there is a harmonisation of regulations. Italso addresses the legal systems and automation of technology which in many cases has occurredfaster than the legal reform resulting in both legal gaps and legal setbacks. The research identifies the necessity of developing a balanced legal and technical environment to improvetrust and flexibility, and crossborder functionality of the smart contract in the context of digitaleconomies. Thus, making it longlastingly sustainable and successfully linked to the international currents of laws.
